While legalization in North Carolina for 2022 looks very promising, currently the state does not have a legal cannabis market. Possession charges for ½ oz or less are considered a misdemeanor with a $200 maximum fine, possession of ½ oz up to and 1.5 oz is considered a misdemeanor with up to 45 days of incarceration and a $1,000 maximum fine. Charges of more than 1.5 oz are considered a felony with up to 8 months of incarceration and a $1,000 maximum fine. As previously mentioned, activists are hopeful for cannabis reform in 2022, a recent poll showed that 82 percent of voters in the state are in favor of legalizing medical cannabis.

Current North Carolina Cannabis Legalization efforts

NC compassion act passed through a 35-10 vote passed June 2nd and received final passage with a 37-6 vote on June 6th sending it to the House of Representatives for further consideration. Although the bill passed through four separate committees in the senate, it is widely perceived that it will not go as smoothly in the House, as recently activists are unsure of leadership approval from the chamber. Republican House Speaker Tim Moore has expressed concerns of this bill and the likelihood of abuse due to patient access to cannabis. The legislative session is set to end on June 30th.

NC Compassionate Care Act details:

Qualifying conditions: The bill defines qualifying conditions as anything that is considered a “debilitating medical condition” which includes, cancer, epilepsy, HIV/AIDS, Parkinson’s disease, multiple sclerosis and PTSD.
Would allow for up to 10 medical marijuana suppliers that control the cultivation and sale of cannabis with each supplier being allowed to open 4 retail dispensaries throughout the state.
Patients can possess up to one and a half ounces of cannabis however the bill does not allow for home cultivation.
This bill would allow for specific infused products as well as smoking / vaping products.
